Data Protection


 

1. Content of the online presence
The Ministry for Rural Development, Environment and Agriculture of the State of Brandenburg (MLUL) does not accept any guarantee for the up-to-dateness, correctness, completeness or quality of the information made available on mlul.brandenburg.de, nor for the information of the State Office for Environment (LfU) on lfu.brandenburg.de. Liability claims which relate to damages of a material or non-material kind and which were caused by the use or non-use of the information made available or by the use of erroneous or incomplete information are strictly excluded, provided no demonstrably wilful or grossly negligent fault on the part of MLUL or LfU can be proven. MLUL and LfU explicitly reserve the right to alter, make additions to, or delete parts of the pages or the entire online presence or to temporarily or permanently discontinue publication.

2. References and links
With direct or indirect references to external internet sites ("links") which are outside the area of responsibility of MLUL or LfU, a liability obligation would only be effective in the case that MLUL and LfU had knowledge of the content and it would be technically possible and reasonable for them to prevent usage in the case of illegal content. For content above and beyond this and in particular for damages which occur due to the use or non-use of such types of information presented, the website host is solely liable. 

MLUL and LfU hereby explicitly declare that at the time the links were made no illegal content was discernible on the linked websites. When making the initial link MLUL and LfU check the external content as to whether any possible responsibility under civil or criminal law exists. Under the Telemedia Act (TMG) MLUL and LfU are not, however, obligated to continually check the content which is linked on its website presence and which could then establish responsibility. MLUL and LfU therefore distance themselves explicitly from all content on linked websites which are altered after the link has been placed on their websites. This statement applies to all links and references within the internet presences of MLUL and LfU

Only when MLUL or LfU ascertain or are informed by another that a specific website presence to which MLUL or LfU has made a link available has given rise to responsibility under civil or criminal law, shall the reference to this internet presence be removed, insofar as this is technically possibility and reasonable. The technical possibility and reasonableness shall not be influenced by the fact that even after the prevention of access from the websites mlul.brandenburg.de and lfu.brandenburg.de the illegal or criminal internet presence can be accessed from other servers. This also applies in particular proxy servers and search engines with a mirror function.

3. Copyright and labelling law
The State Government of Brandenburg is the sole owner of the domain name "brandenburg.de". All rights on these pages lie with the State Government of Brandenburg. Secondary use of the internet presence of the Ministry for Rural Development, Environment and Agriculture of the State of Brandenburg (MLUL) of any kind and also in part or by linking on other websites require the permission of the Department for Press and Public Relations. Re-using the material of the internet presence of the State Office for Environment of the State of Brandenburg, regardless the type and the extract, or linking to other websites, requires the permission of the LfU Public Relations Department. MLUL and LfU strive to respect copyright of the graphics, audio files and texts used in all publications, to use on graphics, audio files and texts which have been created by MLUL or LfU or to draw on licence-free graphics, audio files and texts. Should, however, an unlabelled, yet external copyright protected graphic, audio file or text be found on the respective pages, then the copyright was not able to be determined. In the case of such an unintentional copyright infringement MLUL or LfU shall remove the corresponding item from their publications or label it with the corresponding copyright after receiving notification. 

The copyright on published items created by MLUL or LfU remains solely with the authors of the website. Duplication or use of such graphics, sounds or texts in another electronic or printed publication is not permitted without the explicit permission of MLUL or LfU. 4. Legal validity of this liability exclusion
This liability exclusion is to be regarded as part of the internet presence to which this page has been linked. Should parts or individual formulations in this text not, no longer or not completely correspond to the current legal position, then the remaining parts of this document remain unaffected by this in terms of their content and in their validity.

5. Data protection notice
Should the opportunity arise within the internet presence to enter personal or business data (email addresses, names, addresses), then the divulgence of this data on the part of the user is explicitly on a voluntary basis. 

Unsecured emails offer the opportunity for attacks on confidential communication; emails can be viewed, information can be altered, falsified or deleted and communication profiles can be created. It is therefore urgently suggested that you send confidential information via the post, instead of a communication via email. 

Each time a user accesses a page from the internet presence mlul.brandenburg.de or the internet presence lfu.brandenburg.de the following data about this event is saved in a logfile:

  • IP address of the requesting computer, 
  • Date and time of access, 
  • Name of the accessed file and ID, 
  • User agent 
  • Type of browser
  • Host 

The data which is saved is solely analysed for statistical purposes. It is not passed onto third parties. On this website cookies are used to graphically mark articles which have already been read. These cookies are used by the authors to track the users' access behaviour.

6. Important information
The email correspondence with MLUL Brandenburg or LfU Brandenburg is primarily available purely as a communication channel. It should be pointed out that applications or written submissions cannot be submitted by email in a way which is effective in law. Should your message contain a such a written submission, then a repeat forwarding via post is absolutely necessary. When using the email access of MLUL Brandenburg or LfU Brandenburg, please also give your postal address in addition to your email address, as it is not always possible for us to answer all emails via electronic means for internal administrative reasons.
